User Agreement for Noupia AI Services.
These are the Terms and Conditions governing your access to and use of the website www.Noupia.ai and its related sub-domains, sites, services, tools, and mobile application (the "Site"). By accepting these Terms and Conditions (including the linked information herein), and by using the Site, you ("you" or the "Customer") represent that you agree to comply with these Terms and Conditions.
1. Service Provided
Noupia.ai provides a platform that allows users to create personalized AI avatars.
These avatars can be custom built to match your preferences, using a variety of variables such as skin tone, hair color, eye shape, clothing style, and more.
After creating an avatar, users have the ability to download their design for personal or commercial use as outlined in our copyright and usage policies.
Users can also share their created avatars on various social media platforms through in-built sharing functionality.
We continually work to enhance our services and may offer additional features and functionalities in the future.
Such enhancements will fall under these Terms of Service unless expressly mentioned. While we strive to keep our service operational 24/7,
we do not guarantee its availability at all times. There may be periods of downtime for maintenance and updates, or due to unforeseen issues beyond our control.
Noupia.ai is not responsible for the actions of users or the content they create using our service. Use of our service to create inappropriate or
offensive avatars or misuse of our technology for unlawful activities is strictly prohibited and will result in termination of access to our service.
2. User Responsibilities
As a user of Noupia.ai, you agree to respect and adhere to all applicable laws and regulations, both local and international, related to online conduct and acceptable content.
You are solely responsible for any data, text, files, information, usernames, images, graphics, photos, profiles, or any other content that you submit, post, or display on
or via the service.
You vouch that you have all necessary rights and permissions to post such content and that such content does not and will not infringe or violate any
third-party rights, including but not limited to trademark, copyright, or other proprietary or privacy rights. You agree not to use our services for any illegal or
unauthorized purpose, including but not limited to the creation of AI avatars in any manner that breaches data privacy laws, discriminates or promotes hate towards an
individual or a group on the basis of race, religion, gender, or otherwise violates acceptable norms and ethics. Further, you commit to maintaining a respectful and civil
behavior while using Noupia.ai. Harassment, trolling, spamming, or any form of malicious behavior will not be tolerated and may
result in immediate cancellation of your account without notice.
You, as a user, will be held liable for any damage or harm resulting from your failure to comply with laws and regulations or the violations of these Terms of Service.
3. Intellectual Property Rights
All intellectual property rights related to the AI avatars created on Noupia.ai, the Noupia.ai website, and all related graphics,
logos, service marks and trade names used on the site, remain the sole property of Noupia.ai and its licensors, and are protected under international copyright,
trademark and other intellectual property laws.
Unauthorized use of any such property without the prior written consent of Noupia.ai or its licensors, as applicable,
is strictly prohibited. Users will retain ownership over the original content they provide for the avatar creation process but grant Noupia.ai a worldwide, non-exclusive,
royalty-free license to use, reproduce, modify, adapt, publish, distribute, and display such content on Noupia.ai and related marketing and promotional channels for the
purposes of providing and promoting the services.
AI avatars created on Noupia.ai are for personal use only unless otherwise explicitly indicated or agreed upon through
additional contractual arrangements. Commercial use, including but not limited to sale, resale, license, or distribution of AI avatars created on Noupia.ai requires prior
written consent from Noupia.ai. Any infringement on the intellectual property of Noupia.ai or misuse of its services for intellectual property theft will be dealt with sternly,
including legal actions, as applicable.
